1. INTRODUCTION


Welcome to Avail Trade.com also hereby known as “we", "us" or "Avail Trade". We are an online marketplace and these are the terms and conditions governing your access and use of Avail Trade along with its related sub-domains, sites, mobile app, services and tools (the "Site"). By using the Site, you hereby accept these terms and conditions (including the linked information herein) and represent that you agree to comply with these terms and conditions (the "User Agreement"). This User Agreement is deemed effective upon your use of the Site which signifies your acceptance of these terms. If you do not agree to be bound by this User Agreement please do not access, register with or use this Site. This Site is owned and operated by

1. RULES OF USE

1.You must be a registered member of Availtrade with a valid account and have successfully made and completed a purchase of goods and/or services on availtrade.
2.Any eligible Sellers on availtrade.com International Website  participating in Product Sell  will make available certain products  and specify (a) the Availtrade account;  shall refer to the minimum order quantity for any Participating Product in any single Product Buy order  placed by any buyer. “Max Order's” shall refer to  the minimum total order quantity to be received from one or more Product Orders at the end of the Available Period.
3.All Participating Products are available for a prescribed period as indicated on the relevant webpage Available Period to accept orders from interested buyers.
4. The number of days (appearing/confirmed on the product listing page at the time when the Eligible Member completed the purchase from the seller on Availtrade) which the seller guarantees the Eligible Member that it would receive the goods and/or services ordered from the seller, start counting from the day the Eligible Member completes such purchase on Availtrade.
5.By participating in this Buyer Protection, you agree to be bound by these Official Rules.
6. Any fraud and/or abuse by you as determined by the Promoter at its sole discretion will result in forfeiture of your eligibility to this Buyer Protection and/or rights under these Official Rules.
7.You acknowledge and agree that the Promoter or any of its affiliates shall not be responsible, and shall have no liability to the Eligible
 Member or anyone else for any dispute or claim that arises out of your participation in this Buyer Protection.

8.In the event that Product Buy is ceased or suspended by any relevant authority or due to serious network attack or system fault, it may no longer be available. Such situation shall constitute a force majeure event. Neither availtrade.com nor any Participating Seller shall be liable for any damages or claims that arise in connection therewith.
9. in the event where there is any dispute, time and validity of any transactions hereunder shall be determined by availtrade.com at it sole discretion based on its records. If there is any discrepancy between the record of transaction held by any
 buyer and that held by availtrade.com, availtrade.com’s record shall be conclusive and binding.
10.reserves the right to amend these Terms and Conditions as well as to vary or terminate Product Buy (any part thereof) without prior notice.
 In the event of disputes, the decision of availtradde.com shall be final and binding.
11.Notwithstanding anything to the contrary in these Terms and Conditions, availtrade.com reserves the right and absolute discretion to disqualify, cancel or revoke the right of any buyer to use Product Buy without any liability, upon its discovery of any involvement of dishonest, malicious, fraudulent,unlawful and/or inappropriate acts, or, of violation of these Terms and Conditions, by the buyer. availtrade.com reserves the right to take legal action as it may deem necessary.
12.Depending on the local tax and customs policies of the destination country where you are located, you may be required to pay custom duties, taxes and other applicable costs and/or fees that may be imposed thereby.

13.Each buyer hereby acknowledges and agrees that availtrade.com and/or any of its affiliates shall not be responsible, and shall have no liability to it or anyone else for any dispute or claim that arises out of the buyer’s use of Product Buy.
14.When a buyer or seller issue arises, we may consider the user's performance history and the specific circumstances in applying our policies.We may choose to be more lenient with policy enforcement in an effort to do the right thing for both buyers and sellers. The foregoing does not limit or impair our right to refuse, modify,or terminate all or part of our Services to anyone, or to terminate this agreement with anyone, for any reason at our discretion.
14.These terms and conditions are governed by and construed in accordance with the laws of The People's Republic of Bangladesh.You agree that the courts, tribunals and/or quasi-judicial bodies located in Dhaka, Bangladesh shall have the exclusive jurisdiction on any dispute arising inside Bangladesh under this Agreement.
15. In case of any discrepancy in the content between the English and other non-English language versions of these Terms and Conditions (if any),the English version shall prevail.
